In a significant development, Palestinian authorities have expressed their intent to join South Africa in a case before the International Court of Justice (ICJ), where Pretoria has accused Israel of “genocide” in Gaza. This move comes as a notable escalation in the legal battle between Israel and its accusers on the international stage.

South Africa initiated the case last year, alleging that Israel’s military offensive in Gaza violated the 1948 UN Genocide Convention, a charge vehemently denied by Israel. The Palestinian participation in this legal endeavor marks a strategic step, as they seek to amplify their voice and interests in the ongoing proceedings.

Although Palestinian representatives have been present at the hearings in The Hague, they have now formally requested permission from the ICJ to intervene in the case alongside South Africa. Their application emphasizes a “special interest of a legal nature” that may be impacted by the court’s decision.

The ICJ confirmed the Palestinian request in a statement issued on Friday, noting that the State of Palestine submitted an application for intervention and a declaration of intervention on May 31. The court, established post-World War II to arbitrate disputes between states, now faces the task of considering the Palestinian plea for involvement.

Highlighting their commitment to the cause, Palestinian authorities underscored their accession to the Genocide Convention in 2014, a move aimed at reinforcing their legal standing in the proceedings. Notably, the ICJ has previously ruled on the matter, issuing directives to Israel concerning access for UN-mandated investigators and measures to prevent acts of genocide during military operations in Gaza.

Despite the court’s authority to issue legally binding rulings, enforcement mechanisms remain a challenge. For instance, past ICJ orders, such as the directive to Russia to cease its invasion of Ukraine, have faced implementation hurdles. Nevertheless, the impending deliberation on the Palestinian request underscores the complexity of the legal landscape surrounding the Israeli-Palestinian conflict and the pursuit of justice on the international stage.
