Nicaragua seeks emergency measures from the ICJ, accusing Germany of aiding genocide by providing military aid to Israel and defunding UNRWA

Nicaragua has brought a case to the International Court of Justice (ICJ) against Germany, accusing it of providing financial and military assistance to Israel and withdrawing funding from the UN Palestinian Refugee Agency (UNRWA), the top court of the United Nations announced Friday.

In its filing with the ICJ, Nicaragua requested emergency measures requiring Germany to cease its military aid to Israel and reverse its decision to halt funding for UNRWA.

Nicaragua’s claim asserts that Germany’s actions violate the 1948 Genocide Convention and the 1949 Geneva Conventions regarding the laws of war in the Palestinian territories under occupation.

“By providing military equipment and now withdrawing support from UNRWA, which offers crucial assistance to civilians, Germany is aiding in the commission of genocide,” Nicaragua stated in its legal submissions.

Several significant donors to UNRWA, including the United States and Germany, suspended their funding after reports emerged that around 12 of the agency’s Palestinian employees were suspected of involvement in the Oct. 7 attacks in Israel by Hamas.

The filing from Nicaragua argues that urgent measures are necessary due to Germany’s alleged role in the “ongoing plausible genocide and serious violations of international humanitarian law” in the Gaza Strip.

This case follows a similar action by South Africa against Israel, accusing it of committing genocide against Palestinians in Gaza.

Recently, the ICJ ruled that South Africa’s claims of Israel’s violations of the genocide convention were credible, issuing emergency measures that included a demand for Israel to cease any potential acts of genocide in Gaza.
