Türkiye’s Constitutional Court gives crucial ruling on rector appointments

The Constitutional Court on Tuesday annulled President Recep Tayyip Erdogan’s authority to replace the governor of the Turkish central bank before the end of his term. It also annulled a decree law and a provision of the law on the appointment of university rectors by President Erdogan.

The Constitutional Court has declared the regulation concerning the appointment of university rectors by the president as unconstitutional. The court emphasized that rector appointments cannot be made through decrees with the force of law. Consequently, the court has provided a one-year deadline, starting today, for the formulation of a new regulation.

The decision of the Constitutional Court regarding the lawsuit filed by the main opposition party, the Republican People’s Party (CHP), for the annulment and suspension of execution of certain articles of Decree Law No. 703 has been published in the Official Gazette.

The Constitutional Court’s ruling entails the annulment of the decree law pertaining to rector appointments, with the directive that the annulment will take effect 12 months from today.
