Israel criticizes South Africa’s International Criminal Court (ICC) appeal, alleging misuse of jurisdiction in response to Israeli military operations in Gaza
Israel has accused South Africa of misusing the jurisdiction of the International Criminal Court (ICC) by seeking new measures in response to Israeli military plans to extend its ground operations into the city of Rafah in southern Gaza.
According to Israel, South Africa’s request is seen as unusual and improper, as it fails to address the planned military action directly.
Tel Aviv has strongly refuted the accusations brought forth by South Africa for alleged violations of the Genocide Convention, denouncing them as baseless and morally reprehensible. Israel argues it adheres to international law in its operations in Gaza and contends that recent ICC rulings have already addressed similar matters.
Israel has criticized South Africa for what it perceives as insufficient information provided to the court regarding the actions of the Palestinian group Hamas. It also accuses South Africa of using the ICC’s preventive measures as a tool against Israel rather than a means of protection.
Furthermore, Israel asserted that the ICC lacks jurisdiction over minor armed conflicts in Gaza and accuses South Africa of attempting to undermine Israel’s right to self-defense, citing its ties with Hamas.
Israel has urged the ICC to reject South Africa’s plea for additional measures.
Meanwhile, South Africa has submitted a request to the ICC for an urgent evaluation of Israel’s intentions to expand its military presence in Rafah. South Africa has called on the court to consider whether it should intervene to prevent further violations of Palestinian rights.
